Products
The gifts delivered to the recipient will be generally as per the description of the article and as per the picture chosen by the customer. There may be variations in appearance and colours or design especially in the perishable goods like flowers, cakes and chocolates and sweets.
The non-perishable goods may also have variations in appearance, colours or design. The customer agrees to the variations and understands the nature of the variations and allows Giftmela.com to deliver a product similar to the product picture exhibited on the web site. Also,
• Products may become unavailable at short notice.
• Request for cancellations of orders placed can be made by phone or by email within 24 hours of placing an order provided the goods in question have not already been shipped.
Payments
All prices are in US Dollars. Payments will only be accepted in US Dollars and charged to the credit card in US Dollars. If you use a non-US credit card, your bank will automatically convert to your home currency based on today's exchange rates. All prices are subject to change without prior notice.
• For any goods that have to be delivered outside of Bangladesh, all customs and duties shall be levied once the goods reach their destination. All such charges shall be borne by the recipient of the product. For international deliveries it is not always possible to foresee any custom duties. By placing an order for international delivery (e.g. other than Bangladesh) you have specifically agreed that such government levies, taxes and any delivery charges will be borne by yourself.
• Delivery process will commence only after the approval and confirmation of your credit card.
• In case of high value order that is above $100, we require the credit card back and front fax to us. This process is to ensure the security of the transaction.
Accuracy of information and intent of making payment
The customer promises that the information provided to Giftmela.com will be true, current, correct and accurate including credit card numbers and addresses. The customer also agrees to pay all charges incurred by them and users of the account and credit cards or other payment mechanism at the prices in effect when such charges are incurred.
Indemnification
The customer agrees to defend, indemnify and hold Giftmela.com and its affiliates harmless from any and all liabilities, costs and expenses, including attorneys' fees, related to any violation of this Agreement by them or the authorized users of the account.
The customer also agrees to defend, indemnify and hold Giftmela.com and its affiliates harmless from any and all liabilities, costs and expenses, including attorneys' fees, in connection with the use of the Service or the placement or transmission of any message or information or other materials by you or authorized users of the account.
Giftmela.com may modify this Agreement from time to time by changing the above terms and condition. The terms and conditions applicable to the customer will be the ones that were prevailing on the day and time you placed your orders.
We do not accept RETURNS or EXCHANGE gifts after shipping.
We do not CHANGE or CANCEL AN ORDER after shipping.
We do not replace LOST or STOLEN gifts or gift certificates once received by the recipient.
We are not responsible for delivery to the wrong address if that is the address given to us by the customer.
We are not responsible for late deliveries in case the recipient is not at home.
We do not guarantee freshness of the goods delivered if the recipient is not at home at the time of delivery.
Although Giftmela.com will make every effort to guarantee on time delivery, however, delivery may be delayed due to uncontrollable circumstances like flood, storm, strike, fire, accident, earthquake, riot, wrong destination address etc. Giftmela.com cannot be held responsible for any such uncontrollable circumstances. |
